Terms of Service
PurePower Streams aka PPS is a stream service provider. All customers under our service are subject to the terms and conditions described in this document. Under the terms of this agreement, signing up and/or using our service in any form indicates that you have read, understand, and agree to the terms and conditions stated below. PurePower Streams reserves the right to make alterations to this document whenever we deem reasonable. It is the client's sole responsibility to check this document for updates on a regular basis.

Acceptable Use, Copyrights & Restrictions
All material on this site, including but not limited to text, images, illustrations, code, scripts and audio or video clips/live audio is owned and controlled by PurePower Streams. Material from this website may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, unless we give you the written permission to do so.
Streaming, Content Hosting & Licensing
PPS does not actively monitor stream content and all content broadcast is the sole responsibility of the client.
We do not provide any form of legal cover to individuals or companys who utilize our services to distribute content with any copyright protection. Under no circumstances will PurePower Streams be responsible for the actions of our clients or their users when found to be broadcasting protected content. All licensing, copyright and royalty issues are the sole responsibility of the individual clients and/or their production entities.
You may not use our services to distribute racist or any other unsociable material. While streaming in any virtual world, you are bound by that site's terms of service and/or rules of conduct.
PurePower Streams will make every effort possible to ensure security of clients' data, however due to the large volume of media stored, our prices do not include backup of data. All data is stored at clients' own risk. We will assume no responsibility for any loss, damage or corruption of files hosted on our servers.
All live streaming purchased from PurePower Streams is limited in bandwidth by a bitrate of 64kbps or 128kbps. If you choose to stream above the purchased bitrate on a live server, you run the risk of your stream being interrupted automatically for bitrate abuse. The server automatically checks every 5 minutes for streaming above the allotted bitrate. If your stream is interrupted for this reason, you will be required to contact tech support in order to have your stream reactivited. Repeated abusers may incur restart fees.
Understand that PurePowerStreams will not provide a full version of any broadcasting software to run your stream, nor will we provide the music for your stream. It is up to the stream user, To get, purchase and license any software or music.
Personal streams are designed for single DJ streams that are played on media players from a web page. Stream address can be played within Virtual Worlds. These streams are not for sharing with others and stream sharing is not allowed. Under no circumstances may Personal Streams be used by other than the licensed user without written permission of PurePower Streams.
Auto DJ Streams are designed for multiple DJ's to sign in to your "station" and plays music 24-7. space for uploading music, an Auto Control Panel to access the Auto DJ Manger.
Auto DJ Streams are to be
(1) Only used in the owner's own domains and properties
(2) Only used as a DJ's personal auto stream which can be used in other virtual worlds' domains, provided that the stream is removed at the conclusion of the DJ Owners DJing event.
Personal Streams and Auto DJ Streams may not be resold, leased, or otherwise transferred to other users without written permission of PurePower Streams.
Embed codes for all stream players are available on the player itself and are freely distributed. Such embed codes provided to clients by PurePower Streams to be embedded on third party websites or social networks are subject to a reasonable use policy. Although this is not actively monitored, we may from time to time check to ensure users are not using an unreasonable amount of resources or stream sharing.
We reserve the right to monitor, restrict, suspend or bill clients found to be using a disproportionate level of resources on a regular basis. In any such case, we will first contact the user to try and find a solution including, but not limited to attempting to compress media to reduce resource usage, upgrading to a higher level of service or restricting download/resource usage.
Our SHOUTcast streams are not limited on bandwidth or data transfer unless otherwise specified, and any additional limits such as bitrate and listener slots are clearly laid out on our home page list of available packages, and on our stream application.
Clients are given the opportunity on their stream application to chose the Stream Name that will appear on their player. There is a name change fee that will incur for each Stream Name change to the player. PurePower Streams techs may be contacted for details.
Please notify PurePower Streams via email or profile page mail of your in-game profile name changes, so that we can locate you if necessary.
Payment, Cancellation and Refunds
Services are billed on a monthly subscription basis unless otherwise specified. Payment will be due on the first through the fifth of every month and will continue until a written cancellation request is received via skype or game mail. Reminders for overdue stream payments will be sent out between the sixth and the eighth. Failure to pay for services delivered may result in suspension of services.
We offer a 24 hour 'cooling off' period for new customers. Refunds are available for 24 hours after any payment is made by a new customer for a new service, providing the service(s) provided have not been used. It is the clients responsibility to keep track of all payments made. Any refunds given will be minus any setup, admin or processing fees at our discretion.
Any new stream that has been setup for which no payment has been made within 24 hours of the new stream setup will not be activated for streaming until the payment is made.
Excessive Tech Help Requests: In rare cases, a stream owner will break their broadcasting software, foul up auto DJ systems, have data coruption, hard drive failure, etc... on a daily basis. If PurePower Techs deem you a Problem DJ in this regard, we reserve the right to terminate your stream. Any refunds given will be minus any usage, setup, admin or processing fees at our discretion.
You are not eligible for any form of refund if you have breached the terms of service in any way. This includes exceeding the agreed bitrate limit , broadcasting unsuitable content or if you are found to be stream sharing.
All payments billed to existing clients are non-refundable. Clients wishing to cancel our service should contact us in writing via Skype, email or profile page mail before the next billing date. We may ask clients for verification details before cancelling an account, and clients are expected to reply promptly with the requested information. Cancelling a PayPal or Card subscription directly without notifying us may result in an instant termination of service.
Support and Communications Policy
Customers who require technical support can contact us at any time via Skype, email or profile page mail. We attempt to respond to all requests within 24 hours, and most support requests are replied to and resolved well within this time frame. However, our standard products do not include any form of support time response guarantee unless otherwise specified. PPS Service Tech may develop dedicated service agreements with clients, at the tech's own discretion. PPS is not responsible for such agreements. We provide technical support via other lines of communication such as live voice or written chat via Skype. A group Skype chat is also available for all clients use, for issues that may arise and for ease of contacting PPS Techs. The group chat is used for sharing of information, DJ gigs etc. If you are in the chat group and the Skype notifications become bothersome, this can be fixed: While the chat group is open in your Skype, click the "Conversation" tab at the top of your Skype, and select "Notifications". There you can adjust the notifications you receive for that chat group.
Clients are expected to be courteous and professional in their communications with PurePower Streams, our Techs, and other Clients. Under no circumstances will we tolerate any kind of verbal, physical, written or other abuse (including threats of abuse or retribution) of any PurePower Streams customer or employee. If such abuse is proven, it may result in immediate account termination. What constitutes abuse, and what steps may be taken, is up to the sole discretion of PurePower Streams management.
PurePower Streams agrees to offer support to clients only on topics directly relating to our products and services. Our PurePower Tech Team is there to assist clients with any problems directly relating to the availability or functionality of our service, and billing issues. Our support service does not cover generic computer or website advice. We always try to help clients as much as possible; however, it is important for clients to acknowledge that their hardware/software setup is unique and it is not always possible for our support techs to offer 100% resolution of all problems. Help videos are provided for basic issues, and are available on the DJ Help tab of the PurePower Streams home page.
The PowerPack Tech Team also provides service using remote viewing software to troubleshoot clients' software. By submitting your approval for a tech to access your computer via the remote viewing software, you agree to make no claims against PurePower Streams for any issues that may arise as a result of this action.
The PowerPack Tech Team will service and assist PurePower Streams customers only. Customers of other stream service providers should contact their provider for technical support, or become a customer of PurePower Streams in order to receive our exemplary technical support.
Tech Fee Policy
Tech fee charges may apply and are up to the sole discretion of PurePower Streams management and PurePower Tech Team members regarding the amount of the fee. What will incur a tech fee charge includes but is not limited to: Broadcaster Set ups, Data Base Fix, Microphone testing and adjustments, player name changes, advanced DJ lessons, advanced auto dj config, advanced tagging instructions and general help that may require excessive time to accomplish.
Conditions of This Document
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein. PurePower Streams may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.
TO THE EXTENT ALLOWED BY APPLICABLE LAW, IN NO EVENT SHALL PUREPOWER STREAMS, SHOUTCAST, OR ITS DATA CENTER SERVICE PROVIDER BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, ANY LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF USE OR DATA, INTERRUPTION OF BUSINESS, OR FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, EVEN IF PUREPOWER STREAMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
IN NO EVENT WILL PUREPOWER STREAMS OR ITS SUPPLIERS BE LIABLE FOR ANY CLAIM AGAINST LICENSEE BY ANY THIRD PARTY. IN NO EVENT SHALL PUREPOWER STREAMS OR ITS SUPPLIERS BE LIABLE FOR THE FOLLOWING: (I) ANY REPRESENTATION OR WARRANTY MADE TO ANY THIRD PARTY BY LICENSEE, ANY DISTRIBUTOR OR THEIR RESPECTIVE AGENTS; (II) FAILURE OF THE PRODUCTS TO PERFORM; (III) FAILURE OF THE PRODUCTS TO PROVIDE SECURITY.
